General Mohyal Sabha - GMS Constitution
INTRODUCTION
The General Mohyal Sabha was originally constituted by the Mohyal Community in 1901, at Lahore now in Pakistan. It was first registered as a Society in 1924. After partition, it was shifted to India in 1948 and started functioning at Amritsar. For purposes of better-coordinated working, it was soon after shifted in Delhi where it was again registered on 16th August 1955 and since then functioning as such.
Now, in order to give a wider and more effective scope, the Sabha’s activities need to be extended, so as to serve the general public, AND, accordingly, THIS CONSTITUTION.
PREAMBLE
General Mohyal Sabha has been constituted at Delhi, with the efforts of the Mohyal Community comprising of its sub castes namely Bali, Bhimwal, Chhibber, Dutt, Lau, Mohan and Vaid, devoting itself for the progress, prosperity and welfare of the general public.

ARTICLE 1: Name
The Sabha shall be called GENERAL MOHYAL SABHA, DELHI, hereinafter referred to as the GMS and shall be the sole reprensentative of 'MOHYALS'.
ARTICLE 2: Office
The registered office of the GMS shall situate in the UNION TERRITORY OF DELHI. At present it is situated in the premises of A-9, Qutab Institutuinal Area, USO Road, New Delhi - 67.
ARTICLE 3: Jurisdiction
The GMS being the sole representative of MOHYALS, its jurisdiction, shall extend to the whole of INDIA including MOHYALS residing abroad and as determined from time to time by the GMS.
ARTICLE 4: Definitions
In this consitution and its RULES & Regulations:-
1. Word 'MOHYALshall mean and include a person of either sex, belonging to any of the seven sub-cates namely, BALI, BHIMWAL, CHHIBBER, DUTT, LAU, MOHAN and VAID.
2. Word 'GMS'shall mean the "GENERAL MOHYAL SABHA".
3. Word 'MANAGING COMMITTEE'shall mean the Managing commitee of the GENERAL MOHYAL SABHA.
4. Words 'EXECUTIVE MEMBER'shall mean a member of the managing commitee.
5. Words 'OFFICE BEARER'shall mean an office bearer of the GMS and of the Managing commitee of the GENERAL MOHYAL SABHA.
6. Word 'MEMBER'shall mean a member of the GENERAL MOHYAL SABHA.
7. Word 'COMMUNITY'shall mean the General Public.
8. Word 'LOCAL SABHA'shall mean a local Mohyal Sabha duly affilated to the GENERAL MOHYAL SABHA operating in any place in India or abroad.
9. Word 'CONSTITUTION'shall mean the constitution of the GENERAL MOHYAL SABHA.
10. Words 'RULES & REGULATIONS'shall mean the rules and regulations framed under the Constitution.
11. Word 'CONFERENCE'shall mean the MOHYAL CONFERENCE.
12. Word ' MITTER'shall mean the MOHYAL MITTER the official organ of the GENERAL MOHYAL SABHA.
13. Word 'BHAWAN'shall mean the MOHYAL BHAWAN, where the Registered Office of the GENERAL MOHYAL SABHA is located.
14. Word 'REPRESENTATIVE MEMBER'shall mean an executive member of the Managing Committee of the GMS who has been duly elected as representative member by a local affiliated Sabha, who shall have the right to participate in the Managing Committee Meetings of G.M.S. Hs shall have the right to vote but not during election of office bearers, which is restricted to directly elected members.
15. Ad-hoc Commitee/CommittesAd-hoc commitee(s) shall mean any Committee(s) appointed by GMS President in case the Local Sabha(s) is(are) in dispute or dissolved, till such time the new sabha is duly formed/activated.
16. For the time being words Area/Territoryshall mean the locality/town where the particular Sabha is named after it.
 
ARTICLE 5: Aims and Objectives
The following shall be the aims and objects of the Sabha:
(i) To promote welfare, progress and prosperity of the general public.
(ii) To provide aid, relief, scholarships, stipends and other assistance to needy and deserving widows, orphans, students, children, aged, sick and mentally retarded persons, for their uplift, maintenance, rehabilitation, furtherance of education, vocational and technical training, medical treatment and social and personal service according to requirements and needs of such persons.
(iii) To establish, maintain and run educational, vocational, technical institutes and prepare, train, inform and guide youth in regard to various avenues where they could be more usefully and remuneratively employed.
(iv) GMS is authorised to take necessary steps to draw up a Trust Deed as Mohyal Foundation Trust. The M.C. of GMS is authorised to draw up the final Trust Deed and may by a special resolution approve its various provisions keeping in view the requirements, welfare and interest of the Mohyal community and all those who are in need of help and succour. The Trust shall be provided, to begin with, a corpus of upto Rs. Two Crores from Mohyal Foundation Fund with the GMS to which may be added such facilities and assests, both moveable and immovable, as the M.C. of the GMS may decide from time to time. The Trust may consist of five or seven Trustees provided that a majority of Trustees shall be appointed, on a tenure basis by the MC of the GMS.
(v) To advise, guide and provide material and financial assistance fororganising and establishing cottage and small scale industries.
(vi) To motivate and induce young men towards agriculture, poultry, animal husbandry and such other allied short term courses including vocational and technical schemes, projects and programmes initiated by government, for adoption as career and where necessary guidance and financial aid provided to them.
(vii) To encourage and help self reliance in forming cooperative societies in respect of various enterprises and consumer goods.
(viii)To organise movements of children and youth clubs through lectures, seminars, cultural programmes, so as to inculcate in them the spirit of social service, human values, simple living and high standard of moral character.
(ix) To inculcate fellow feeling and spirit of love, brotherhood, and service among the members and their families.
(x) To inform, educate and create awareness for the eradication of undesirable customs and ceremonies and propagate economy and simplicity in their performance, so as savings be utilised towards positive and gainful spheres and purposes, intended for the progress, prosperity and welfare of the members.
(xi) To advise, guide, ad, supervise and control the activities of the local affiliated sabhas for their coordinated working at their level and organise, establish and encourage formation of local sabhas with a view to enlarge the scope for the realisation of aims and objects.
(xii) To make efforts, sponsor and cooperate with other Sabhas, associations, organisations, agencies and institutions, having common bonds and faith in the aims and objects of the GMS.
(xiii) To collect, acquire and maintain historical books, records, farmans, hukamnamas, citations, sanads, grants, certificates, government gazetteers and related material on eminent Mohyals and their sketches and biographies and other related material on the origin and growth of Mohyals and through such material establish libraries and maintain archives.
(xiv) To publish articles, hold lectures, seminars, discourses, and 'melas' on the origin and growth of Mohyals and through biographies and sketches on eminent personalities depicting their galJantry, chivalry, courage, devotion, self-reliance, moral character, human values, discipline in life and their religious and saintly orders, so as to stimulate, inculcate, promote and create sense of realisation and awareness in children and youth for adoption of those qualities, disciplines, human values, patriotism and selfless social service to humanity in their life.
(xv) To hold Conferences with a view to propagate, inform, educate and create awareness in the members for the realisation of aims and objects.
(xvi) To propagate, inform, educate and create awareness for the realisation of aims and objects, the monthly official organ of the Sabha, the' 'Mohyal Mitter', shalJ remain in publication and circulation alongwith pamphlets, circulars and other material.
(xvii) To acquire, own and possess property, rent, mortgage or dispose it of in any manner as may be considered necessary and expedient for the GMS functions, so as to realize aims and objects. 18. To raise funds through subscription, donations, grants in aid and accept trusts and bequeaths, so as to realize the achievement of aims and objects.
 
ARTICLE 6: Patron, Partisht and Life Members
(i) PATRONS
(a) A Mohyal being a member or otherwise, if he / she donates Rs. 11,OOO/- or such higher amount as from time to time fixed by the Managing Committee. shall be entitled to become Patron of the GMS and in consequence thereof, shall become life member of the Sabha without payment of any fees and shall also be supplied complimentary copy of the Mohyal Mitter for life. Further. by virtue of becoming a Patron, he may be nominated as a trustee and/or a member on the Advisory Committee of the GMS.
(b) A distinguished member of wide experience and maturity and dedicated to the cause of the GMS or a person holding high office or commanding eminence in social, political. educational and technical sphere. inespective of any amount donated or otherwise by him, may be nominated as a Patron at a meeting of the General Body of the GMS.
(c) A patron shall be treated as a special invitee at any meeting of the GMS and shall enjoy thc right to votc.
(ii) PARTISHT MEMBER
(a) A Mohyal being a member or otherwise, if he / she donates Rs. 5,000/- or such higher amount as from time to time fixed by the Managing Committee, shall been titled to become a Partisht Member of the Sabha and all the privileges which a patron is entitled to.
(iii) LIFE MEMBER
A Mohyal being a member or otherwise if he / she donates Rs. 1.100/- or such higher amount as from time to time fixed by the Managing Committee, shall be entitled to become a Life Member of the GMS. without payment of any fees for life, and be entitled to get complimentary copy of Mohyal Mitter and can attend the meeting of the GMS and shall have the right to vote.
(iv) ELEVATION OF PATRON, PARTISHT AND LIFE MEMBER
(a) Donations/contributions made by members shall be deemed to be donations for particular purp2ses as per the wishes of the donors. These shall not be elubbed for enabling members to become Patrons, Partisht or Life Members for which purpose members shall make payments specifically as defined(1) and
(b) All cases of elevations shall be placed before the Managing Committee, which on satisfaction, may pass a resolution to that effect and convey the same to the donor concerned.
 
ARTICLE 7: Membership and Subscription Fees
The following shall be the members of the General Mohyal Sabha:
1. Patrons, Partisht Members and life Members.
2. Any Mohyal not below the age of 18 years can apply on proper form and become a member of GMS, by paying annual membership fee of Rs 50/- only, this includes the annual subscription of Mohyal Mitter. The membership will be for Calendar Year. The subscription shall be revised from time to time by GMS Managing Committee. Where member desires to enrol other members of the family as GMS Members through a local affiliated Sabha shall be Rs. 40/- (included MM subscription) and for family member of such existing member it shall be Rs. 10/-. This may be revised from time to time by the GMS Managing Committee.
The members sponsored through Local affiliated Sabhas shall be required to pay 50% of the Membership Fee of GMS (RS. 10/-) applicationto be made on prescribed form.
3. A regular member of a local Sabha, may apply on the prescribed form through the local Sabha, in which case he will stand exempted from payment of admission fee.
4. Any other person, who has common bonds, faith and owes allegiance to the constitution, Rules and Regulations framed thereunder, may apply on the prescribed and has paid the usual fees and subscription towards the Mohyal Mitter, has duly been sponsored by a member of the Managing Committee or is a member of a local sabha has passed a resolution recommending his membership, may be admitted as a member, at a meeting of the General Body of the Sabha.
 
ARTICLE 8: Right to Vote
(a) A member who is not in arrears of his membership fee and subscription to the Mohyal Mitter for the last three months and is not in arrears of loans and advances, if any, shall be entitled to vote.
 
ARTICLE 9: Mode of Voting
(i) Voting shall be by show of hands, by ballot, or by division of the members, as the case may be, except where otherwise provided.
(ii) Except where otherwise provided, all matters shall be decided by the majority vote of the members present. In the event of equal votes on both sides, the President may excercise his casting vote which when done shall be deemed decision by a majority vote.
 
ARTICLE 10: Local Sabha Affiliation
(i) All Mohyal Sabhas, socities, institutions, organisations, foundations or such like bodies going under any other name or title or claiming to represent Mohyal Community or part therof or working for social service to the community must be dully affiliated to the GNS as constituents of the supreme body, that all such bodies mentioned above must come under the discipline of GMS and work within the ambit, tradition an practices of the community and also abide by the guidelines as laid down by the GMS from time to time, that no such bodies as mentioned above will jeopardize the authority of the supreme body i.e. the GMS. All such bodies as mentioned above shall fill a form for affiliation to the GMS on payment of Rs 100/- as affiliation fee and Rs. 50/- as annual renewal fee or as decided by GMS from time to time.
(ii) RIGHTS & OBLIGATIONS OF LOCAL SABHA
(a) "All local affliated Sabhas shall send to the GMS annually along with their renewal of affiliation fee the following:
- List of GMS members on their rolls, with their address.
- List of their local members on their rolls.
- List of their office-beares along with their addresses: telephone numbers (if any) as listed on 1st January of each Calendar year, by 31st January.
(b) A local affiliated sabha shall abide by the GMS Constitution and Rules and Regulations framed thereunder, where applicable, and shall follow the directions issued from time to time by the Sabha.
(c) A local affiliated sabha shall make efforts and assist to form more sabhas in the neighbourhood where such sabhas are not existing and have have them affiliated to the GMS.
(d) If any local sabha or local sabhas refer any dispute or any matter of difference of opinion to the GMS Managing Committee for purposes of arbitration or decision; the award or decision given by the Managing Committee, shall be final and binding on the local sabhas.
(e) The local sabha shall collect funds and donations and remit to the GMS, so as to strengthen its financial position.
(f) All property of the local sabha shall vest
 
ARTICLE 11: General Body of the GMS
(i) CONSTITUTION
(a) The General Body of the GMS, shall comprise of all its members.
(b) There shall be two types of meetins, General Meeting and Extraordinary General Bodt Meeting.
(ii) ANNUAL GENERAL MEETING OR ORDINARY MEETING
(a) There shall be annual Genaral Meeting held ordinarily in the month of April. The quorum shall be 1/3 of the total membership or 40 members, whichever, is less. A clear 30 days notice giving date, time and place of the meeting shall be given to the members. Beside the Annual General Meeting the Managing Committee may, as and when required, call a General Meeting.
(iii) THE FOLLOWING SHALL BE CONSIDERED AT THE ANNUAL GENERAL MEETING
(a) To approve the Annual report and income and expenditure of the GMS.
(b) To approve the budget for the next year.
(c) To approve transfer of funds from one head to another.
(d) To discuss and decide matters as already notified in the agenda.
ARTICLE 11(a): Extraordinary General Meeting
The extraordinary general meeting of the GMS, shall be called in the following circumstances:
(i) When the Managing Committee considers the necessity of calling such a meeting.
(ii) When 1/3 of the total membership of the GMS or 100 members whichever is less, demand in writing that an Extraordinary General Meeting be called and in such a demand clearly express the object or the specific purpose for calling such meeting, the extraordinary General meeting shall then be called within 30 days.
(iii) " The proceedings shall start when 1/3rd of the total members of the GMS are present. Th case quorum is not complete the meeting may be adjourned and the adjourned House reassemble after the time so stipulated by the Chair.
 
ARTICLE 12:The following shall be discussed and considered at the Extraordinary General Body Meeting
Amendments, alterations and deletions to the provisions of the constitution of the GMS and such matters which in the opinion of the Managing Committee should be discussed in the extraordinary general meeting, all other mailers shall be considered in the general body meeting.
FUNCTIONS & POWERS OF THE GENERAL BODY
(i) To do all acts and take adequate measures for the realisation of the aims and objects of the GMS.
(ii) To be the supreme authority and its decision shall be final and binding.
(iii) To elect the Managing Committee for three years.
(iv) To control and supervise the working of the Managing Committee.
(v) To amend, alter and delete any of the provisions of the Constitution of the GMS.
 
ARTICLE 13: Managing Committee
To carryon the work and manage the affairs of the Sabha. there shall be a Managing Committee constituted as under :
(i) Elected by the directly enrolled GMS members
(a) Men ______ 35

(ii) Elected by local Sabhas as Representative Member as per Article 10 clause(viii).
OFFICE BEARERS
The following shall be the office bearers of the Sabha, as also, the Managing Committee.
1. President
2. Vice Presidents - 3
3. Geni. Secretary
4. Secretary
5. Secretary Finance
6. Jt. Secretary Finance
7. Secretary Public Relations
8. Secretary Istri Wing
9. Secretary Youth Wing.
ELECTIONS
(i) The Members shall elect the Managing Committee for a term of three years as far as possible within the month of March. through the Election Committee.
(ii) The Managing Committee shall elect the office bearers for a term of one year, in the month of April every year, through the Election Committee.
(iii) If for certain reasons elections cannot be held on the expiry of the fixed period. the existing Managing Committee and the office bearers, as the case may be, shall continue in their office till the new elections are held. but such arrangement. shall not remain for more than three months.
(iv) Any mid term vacancy caused in the Managing Committee or the office bearers, as a result of
(a) death,
(b) insanity,
(c) resignation
(d) conviction for crime which in the opinion of the GMS renders him unfit for service of the Sabha,
(e) termination as a result of disciplinary action,
(f) withdrawal by a local sabha and
(g) persistent failure to attend meetings.
shall be filled in either by holding supplementary elections or the Managing Committee may fill in such a vacancy by nomination keeping in view the interest of the GMS.
(v) In case any office bearer fails to attend three consecutive meetings of the committee/general body ora member of the managing committee has been persistently absent from attending the meetings of the committee/general body; without any valid reason, as approved by the Managing committee, he may cease to be an office bearer or member of the Managing Committee. The Managing Committee may, condone such absence at their discretion.
MEETING & QUORUM OF THE MANAGING COMMITTEE
(i) There shall be two kinds of meetings of the Managing Committee; firstly, ordinary or Monthly Meeting and secondly, Special Meeting.
(ii) The quorum for ordinary meeting shall be 1;4 of the total membership or 10 members whichever is less and for special Meeting the quorum shall be 1/3 of the total membership or 12 members. whichever is less. In case the quorum is not complete the meeting be adjourned and the adjourned House reassemble after the time so stipulated by the Chair.
(iii) The Ordinary Meeting shall be held once a month or oftener, as the Managing Committee, may deem fit.
(iv) Seven clear days notice shall be given to the members of the Managing Committee specifying the date. time and place of the Meeting and subjects to be discussed.
THE FOLLOWING SHALL BE DISCUSSED AND CONSIDERED AT THE SPECIAL MEETING OF THE MANAGING COMMITTEE
(i) To frame, amend. alter, delete, rules and regulations from time to time, for the conduct of its business and submit for ratification at AGM.
(ii) Election, nomination and disciplinary action in respect of a Member, Managing Committee, trustee, patron, partisht member, life member, affiliated local sabha representative member and any suitably designated person, other sabha, association, organisation / agency or institution, having common bond and faith in the aims and objects of the GMS.
(iii) Preparation of anticipated budget for the next year and consideration of anticipated expenditure during the current year and accordingly sanction of excess expenditure if any.
(iv) Formation of the 8 permanent committees as detailed in clause (iii) under head Powers. duties and functions of the Managing Committee.
(v) Any scheme or project or proposal for the welfare of the Sabha, and consider such schemes which need to be abandoned.
 
ARTICLE 14:Duties and Rights of the Office Bearers
THE PRESIDENT
(i) To preside over the meetings of the Managing Committee. General Body and other Committees and sub-Committees.
(ii) To control. direct and supervise the functions of the GMS and to safeguard and promote its interests.
(iii) To supervise the work of the office bearers.
(iv) To keep an eye on the working of the committees and sub-committees, functIoning under the control of the GMS.
(v) To organise and coordinate local sabhas.
(vi) To adopt special measures in the event of an emergency and to present their account in the next meeting of the Managing Committee.
(vii) In the event of an open or constant opposition to or violation of a mandate or rule or provision of the constitution of the GMS, by a member, office bearer or member of the Managing Committee or a Committee or a Sub-Committee or any of its member or a trustee or a local Sabha, as may be detrimental to the interests of the GMS, may suspend the member or the organisation and arrange for the management of the work entrusted to the member or organisation functioning under it and to present the whole matter in the next meeting of the Managing Committee.
(viii) To delegate any power of his own to a Vice-President or to entrust the execution of any particular work to some one else.
(ix) In special circumstances to spend Rs.l,OOO/- on a single item, in accordance with the budget and present the expenditure at the next meeting of the committee.
(x) In the absence of the President of the Sabha, the Vice-President-I and in his absence the Vice-President-ll & III respectively sha1l be the Chairman of a1l the Meetings and shall perform the duties and enjoy the powers of the President of the Sabha.
(xi) To execute any other duties entrusted by the Managing Committee.
(xii) To ensure the proper maintenance and safe custody of the Trust Documents, Bank and valuable securities, documents, and look at the safety of the property of the Sabha.
VICE-PRESIDENT:-I
(i) To assist the President in the performance of his duties:
(ii) To carry out the work entrusted to him by the President and the Managing Commiuee;
(iii) All powers and duties of the President shall vest in him in the absence of the President.
VICE-PRESIDENT:-II
(i) In addition to the riQhts and duties of the Vice President-I. he shaH also be over all incTlarge of the publication and circulation of the 'Mittel".
VICE-PRESIDENT:-III
(i) In addition to the duties of the Vice-Presidents I & II he will also maintain close co-ordination with affiliated Sabhas, co-ordinate the working of the Matrimonial and Trust Committees.
THE GENERAL SECRETARY
(i) To be responsible for office routine and to handle all colTespondence on behalf of the GMS:
(ii) To take care of all the files, registers, correspondence and documents and other records of the GMS for their proper maintenance and safe custody:
(iii) To record all the proceedingsoftheGeneral Body, Managing Committee and other Committees entrusted to him and present them at the next meeting and after confirmation, same be got published in the 'Mittel'.
(iv) To make special efforts to increase the income of the GMS.
(v) To exercise control over the employees and to supervise their work.
(vi) To call for the reports of the commiuees and sub-committees nominated by the Managing Committee for specific purposes and to present them for consideration of the Managing Committee and or General Body.
(vii) To allocate work among the other secretaries, office-bearers.
(viii) With the approval of the Managing Committee or the General Body, to manage and look after the properties of the Sabha, local sabha if any, to obtain loans, to execute contracts and other agreemeilts, to give authority letters for purchase and sale, and to give general power of attorney for all above urposes and for the conduct of suits in courts.
(ix) To call for the list of members from the local sabhas.
(x) To summon the meetings of the General Body. Managing Committee and other committees in accordance with the rules and regulations.and also send agenda and publish the same in the 'Mitter' where necessary;
(xi) To maintain various registers and records and get these examined by the President and Vice-Presidents;
(xii) To place the monthly accounts before the Managing Committee;
(xiii) To prepare the annual budget of income and expenditure and financial statements after consulting the various committees and get the same approved by the Managing Committee;
(xiv) To prepare the annual report on activities of the Sabha and after approval from the Managing Committee present it to the General Body or Conference;
(xv) To make arrangements and preparations for the conference in consultation with the President and the Managing Committee;
(xvi) To prepare consolidated lists of applications received from widows, orphans, students and other persons, seeking aid and relief and put before the (half yearly) special meeting of the Managing Committee, along with the sanctioned estimates/budget etc.
(xvii) To get all expenditure confirmed by the committee or the president as the case may be, excluding the petty expenses upto Rs.500/- which may be incurred without consulting the President;
(xviii) To execute the resolution and proposals passed by the Managing
Committee;
(xix) To ensure that the elections are held well in advance before the expiry of respective terms and the midterm vacancies are filled in;
(xx) To ensure that at the voting time or when nomination papers for any office are filed, the members are not in aITearS as per rules;
(xxi) Where required issue voting papers to the members and put up before
the committees; and
(xxii) To execute all jobs entrusted to him by the President or the Committee.
SECRETARY
(i) All powers and duties of the General Secretary shall vest in him in the presence of the General Secretary.
(ii) To act accountant and check all accounts and correct them before presenting.
(iii) To send money orders to widows, orphans, students and other persons after the relief and aid to them has been sanctioned by the Committee.
(iv) To keep the account up-to-date of membership, local sabha, representative members, patrons, partisht and life members.
(v) To execute any other job entrusted to him by the General Secretary
or the Committee.
SECRETARY FINANCE
(i) To receive the income of the Sabha, issue receipts, be responsible for the safety of funds, make payments of bills in accordance with the rules and maintain and operate accounts and invest the money with the approval of the Committee.
(ii) To refrain from advancing money not provided for in the approved budget of the Sabha.
(iii) To refrain from making any payment in the absence of an order signed by the Secretary or the President.
(iv) To keep an account of all income and expenditure, check and supervise it and also maintain and keep in safe custody all related vouchers and documents.
(v) To prepare and send to the President and GenI. Secretary the monthly cash book entries together with statement and after approval by the Managing Committee, the same kept in record and such quarterly/ half yearly, statement of accounts be published in the 'Mitter'.
(vi) To maintain a register of employees and on authentication by the GenI. Secretary prepare pay bill for disbursement to them;
(vii) To distribute the sanctioned aid and relief to widows, orphans, students and other persons, obtain receipts and keep proper account and maintain record to that effect.
(viii) To prepare all statements of accounts and ensure that the expenditure does not exceed the sanctioned budget grants.
(ix) To keep the pass books in safe custody and ensure that the interest has been entered and accounted for in the cash book.
(x) To keep only Rs.500/- or as fixed by the Managing Committee cash as imprest and deposit the excess into the Bank.
(xi) To withdraw from the Bank such amount as instructed by the President or the Committee.
(xii) To carry out such other jobs as entrusted by the President or the Committee.
JOINT SECRETARY FINANCE
(i) The duties of the Secretary Finance IOhall vest in him in the absence of the Secretary Finance.
(ii) To carry out all duties entrusted to him by the Secretary Finance with the permission of the President or the General Secretary/Secretary.
SECRETARY PUBLIC RELATIONS
(i) To give publicity to activities of the GMS and the Managing Committee in connection with the uplift and welfare of the general public.
 
ARTICLE 15: Funds
The funds of the GMS shall ordinarily be raised from the following sources:
(i) Members' subscription, admission fee, affiliation fee and subscription from local sabhas and savings from the publication of the 'Mitter'.
(ii) Donations, and contributions from members and non-members.
(iii)Trusts. bequeaths and income and interest therefrom.
(iv)Income from enterprises undertaken and rent and other income from the property belonging to the GMS.
(v)Grants in aid, other grants and subsidies.
(vi)Deposits from members and non members, and
(vii)Loans from members, non members, institutions, associations. agencies, sabhas, government, government undertakings and ALSO, on deposits held by the GMS.
 
ARTICLE 16: Operation of Funds
Funds of the GMS, shall be kept in scheduled Banks, preferably in Banks andPostOffice being government undertakings and twoofthe under mentioned, shall be authorised and competent to operate upon the accounts, one of whom must be the President:
(i) President
(ii) General Secretary
(iii) Secretary Finance
 
ARTICLE 17: General
(i) EXECUTION OF DOCUMENTS
The documents other than cash receipts, shall be executed by at least three office bearers or as may by determined by the Managing Committee from time to time; including President and General Secretary/ Secretary.
(ii) DISPOSAL OF ASSETS
(a) Immovable Property
The GMS shall have the power to dispose of the immoveable property owned by it, provided all the members of the General Body, are supplied with the particulars of the property intended to be disposed of and proposal for the utilisation of the sale proceeds and consent in writing to that effect is obtained from 2/5 of the total membership.
(b) Movable Property
The procedure outlined for the disposal of immoveable property shall be followed. if the book value of the moveable property intended to be disposal of exceeds Rs. 50,000/- and the mode and the disposal of moveable property below Rs. 50,000/- shall be determined by the Managing Committee at a properly convened special meeting.
(iii) ATIAINMENT AND ENLARGEMENT OF AIMS & OBJECTS
To do all such other acts and things as the GMS may consider necessary and conducive to attainment of enlargement of the aforesaid aims and objects or anyone of them.
 
ARTICLE 18: Amendment of the Constitution
(i) The GMS shall have the powers to amend, alter or delete any provisions of the Constitution but this power shall be exercised only at such a meeting of the General Body and adopt a resolution to the effect by 3/5 (three fifth) of the members present and voting.
By circulationof agenda incorporating intended amendment/alteration/ deletion to all members, and a majority 01'3/5 of the total membership vote for the same.
(ii) A motion for amendment, alteration or deletion of any provision of the Constitution may be sent to the Managing Committee by 1/3 of the total membership of or 3,4 of the total membership vote for the same.
 
ARTICLE 19: Notices
All notices of the meeting and all other notices shall be deemed sufficient and proper,
(i) published in Mohyal Mitter,
(ii)if left or posted to the address given by the member, depositor, employee or any person; it being their duty to keep the GMS informed of the change of address, if any.
 
ARTICLE 20: Suits By and Against GMS
In the event of any suit by and against the GMS; the name of such person as appointed for such an occasion, shall from time to time be determined by the Managing Committee of the Sabha.
 
ARTICLE 21: Dissolution of the GMS and adjustment of claims
In the event of dissolution of the OMS, its claims and liabilities, shall be determined by the Managing Committee as deemed expedient by it.
 
ARTICLE 22: Provision of the Societies Registration Act XXI of 1860
All provisions of the Societies Registration Act XXI of 1860 (Punjab Amendment Act 1957) as extended to the Union Territory of Delhi), will apply to the GMS.
